REAL ESTATE CONVEYANCING

Throughout my career, real property conveyances have been a significant portion of my practice. Developed through friends, acquaintances and realtor referrals, real estate is an area in which I find particular satisfaction. Such matters involve my clients' most precious tangible asset - their home. The sale or purchase of a home is considered one of the most stressful events in most individuals' lives. It is my sensitivity to the inherent stress of each transaction which I believe my clients appreciate the most. This sensitivity is evidenced by my accessibility to every client for thorough discussion of all aspects of the transaction.

Each real estate transaction is unique, and a wide array of issues can - and frequently do - arise. The issues can range from liquidity of funds to satisfying mortgage lenders requirements, or from fuel oil spills to radon contamination to the presence of asbestosis. It is my mission to achieve the results my clients want whether the clients wish to conclude the transaction or cancel it. The clients must have a thoroughgoing knowledge of all of the ramifications of each issue before they can decide what they want to do. It is my responsibility to provide that information as completely and timely as possible.

My role in each sale transaction typically includes:

  • Drafting a proposed contract of sale
  • Review of land records for the deed into the sellers, any liens and tax information
  • Negotiation of the terms of the contract of sale with the purchaser's attorney
  • Review of the proposed contract with my clients and the realtors including the inclusion and exclusion of items of personal property and fixtures
  • Attending to the release of funds upon the expiration of any mortgage contingency
  • Arranging my clients pay-off of mortgages, home equity loans and any other liens
  • Calculating closing adjustments to the contract price for property taxes, sewer charges, water and fuel oil
  • Preparation of closing documents
  • Preparation of the closing statement and providing financial details to my clients
  • Providing a copy of all documents in connection with the transaction to my clients
My role in each purchase transaction typically includes:
  • Review of land records for the deed into the seller, any liens and tax information
  • Negotiating the terms of the purchase contract
  • Discussion of the appropriate nature of my clients' joint ownership, i.e., with rights of survivorship or as tenants in common
  • Review of the proposed contract with my clients
  • Responding to the requirements of any mortgage lender
  • Attending to the requirements of the title insurer
  • Reviewing title issues with my client including the desirability of a property survey
  • Calculation of closing adjustments to the contract price for property taxes, sewer charges, water and fuel oil
  • Review of mortgage documents
  • Supervision of the execution of all documents
  • Recording the deed and mortgage
  • Preparation of the closing statement providing financial details to my clients
  • Providing a copy of all documents in connection with the transaction to my clients
