CIVIL LITIGATION
I have represented clients in a wide variety of civil litigation throughout my legal career. The matters have ranged from personal injury claims to mechanic's lien foreclosures and from breach of contract actions to commercial disputes. My clients are individuals and businesses with a small number of employees.
There are a number of common elements in all the litigation in which I have been involved. Each matter requires that my client have realistic expectations about how the matter will proceed, the results to be achieved and the cost in terms of fees, related expenses and the time of my client and other interested persons. Each matter requires a thorough understanding of the applicable law. All the facts, issues, statutes and precedents must be weighed and the costs and benefits must be analyzed as well as possible. In each case a discussion must be had about the fact that there are elements which can not be anticipated since adversaries are not always predictable. In each case, an independent investigation of the facts in support and opposing my client's position must be made. Consideration of the timeliness of each step in the process is always necessary.
Normally an effort to discuss the issues with the adversary prior to commencing a lawsuit is appropriate. The expense of litigation and my client's personal commitment to it makes the exploration of reasonable alternatives to litigation prudent. Even the use of "Alternative Dispute Resolution" procedures, binding or not, is typically worth considering carefully.
As in all areas of my practice, my client's ability to have access to me to discuss current developments and strategy is essential to a productive working relationship. I assure every client of easy access whether I am in court all day or otherwise engaged. In this way my clients are fully informed and are able to make strategic decisions on a timely basis throughout the process of resolving the disputes.
Fee arrangements vary from strictly contingent on success, to hourly billing, to a mixture of each. Cash expenses incurred in every matter are the responsibility of the client.
Litigation is a difficult experience for clients because of the time and cost involved, but it is a reasonable process to protect client's rights and to assure appropriate compensation and actions by others as permitted by law. My commitment to each client is achieving the best possible results as economically as possible.
